Grenelle of Conjugal Violence: Medical secrecy, accommodation, authority of violent fathers... 41 strong measures

This November 25 marks the end of the first Grenelle against domestic violence. Edouard Philippe and Marlène Schiappa have announced 41 measures to try to eradicate this scourge and protect women. We take stock.

The very first Grenelle of domestic violence, which opened on September 3 , ends this Monday. Expected at the turn by the associations, the Secretary of State for Gender Equality Marlène Schiappa and the Prime Minister Edouard Philippe announced today the conclusions drawn by this Grenelle and listed the measures that will be taken soon in France to eradicate violence, help the victims, women and children, but also punish the perpetrators of this violence.
Prime Minister Edouard Philippe began his speech with a tribute to the two last victims of feminicides, Sylvia and Aminata . Since the beginning of 2019, 138 women died under the blows of their spouses or ex-spouses in France. Faced with this fed up and the silence of politicians, a march mobilized 49,000 people on November 23 to say 'stop' to the violence. It is therefore in this climate that the Prime Minister announced the following measures.

  • Budget : Disappointment of feminists. The Grenelle indicated the means that will be put in place by the State: one billion euros will be devoted to gender equality, including 360 million for the fight against violence. Associations and the High Council for Equality asked for a budget of one billion euros to stop the violence. 6 million euros will also be released for the deployment of anti-reconciliation bracelets , the establishment of which has been confirmed by the Prime Minister.
    Marlène Schiappa told the Figaro that the government would co-fund two treatment centers for perpetrators of domestic violence in order to prevent recidivism. The state provides the opening of at least 2 centers of this type per region by 2022 to accommodate, listen to and psychologically monitor violent spouses .
  • Welfare : Face to the (sad) success of the 3919 line, Edouard Philippe announced that the number will be accessible 24 hours a day, 7 days a week . Also, the victims, women and children, will be able to enjoy more accommodation facilities since '1,000 new solutions' are expected in January 2020, allowing victims to leave their homes without ending up on the streets.
    As it concerns the lifting of medical secrecy which is not unanimous among practitioners and politicians, Edouard Philippe indicated that a doctor may, under certain conditions, lift professional secrecy in case of imminent danger to the patient. Gendarmes and police must also be made aware and trained on these issues of violence. To help them, a hazard assessment grid will be at their disposal and 80 social worker positions will be created in police stations to better accommodate victims, by 2021.
  • Education/Prevention : At school, a mandatory training on gender equality and one 'life advice' will be put in place. The latter will allow middle and high school students to submit their ideas for preventing acts of violence and making an annual report. A domestic violence module will be added to National Universal Service to educate young people. For teachers, a reporting document will be distributed to help them detect child victims or witnesses of violence.
  • What will change legally : Edward Philippe has focused on 'legal nonsense' which persist . Among them are the maintenance obligation which will be abolished and which will allow child victims of abusive parents to no longer pay or support their abusers.
    Parental authority in the event of violence will also be suspended: legislation will be proposed by January 2020. Violent spouses possessing firearms will have them confiscated 'from the first complaint'.
    As for moral harassment leading to suicide or attempted suicide, the Grenelle wants to increase the penalties (10 years in prison and 150,000 euros fine) and the creation of a 'new aggravating situation' .
    The Prime Minister said that the notion of influence will henceforth be enshrined in law . “By characterizing it in the law, we thus deal with physical and psychological violence” , he explained during the closing of the Grenelle against domestic violence .
